It is your American right to record in all publicly accessible locations such as: outdoors (off private property), US Post Office, City Hall, Police Department, DMV, and Court Houses, and all government funded facilities. (no not schools)

Your phone is legally being used as a recording device; therefore, those signs are unconstitutional and are implemented for employees -which you are not one. As long as you do not intentionally record behind counters or open non-public doors.

Many are uneducated and it is our advocacy that helps educate: the American public, government officials, and law enforcement.

 

Tyrants/”Blue Lives Matter” Gang are heavily frowned upon by the courts and can cost the city’s department a heavy court cost from settlements due to Civil Rights lawsuits.

Who pays taxes to the city? Americans.

Who pays the salary of all public officials? Americans.

Who ends up paying settlements for the uneducated officials? Americans.

Exercise Your American Rights

The best method is by being non-confrontational, non-disruptive, and be professional. Be patient as more often than not someone will interact with and most likely escalate to police for "trespassing". So long you are in the public (not private property) you are well within your right to refuse ID and continue recording.

Supreme Court has ruled that an officer must have a RAS: Reasonable Articulable Suspicion -of a crime. American citizens arrested for simply recording in public and/or refusing to provide ID have a high rate of judges ruling in their favor, citing the US Constitution. It is typically standard department policy that an officer give his name and badge number when asked, regardless of any situation. You need to be able to document and log a complaint with that information.

Eavesdrop Law: IL - it is OK to record phone calls and record video so long one party is aware (typically it is you). Eavesdrop pertains to the secret recording of a private conversation between unaware parties. Therefore, judges and appeals courts favor the wrongfully arrested by dismissing the charges.

 

Here is a prime example of an Illinois First Amendment Audit at the City of Berwyn (November 2021). Note the respect and calmness of the auditor while being firm on exercising our American rights.
